Terms of Service for Tempo Focus

These Terms of Service ("Terms") govern your use of the Tempo Focus mobile application ("Tempo" or "the App") operated by Stoleru Martin PFA ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility and Geographic Availability

Tempo is available to users worldwide. You must be at least 13 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the App. If you are under 13, you may use the App only with the consent of a parent or guardian. By using the App, you represent that you meet these requirements.

2. Description of the App

Tempo is a focus and productivity application that helps you manage focus sessions, breaks, and app blocking during work. The App offers a free tier and a paid subscription tier called Tempo Pro (also referred to as Tempo Plus).

3. Free and Paid Tiers

Free tier features include fixed focus and break durations (25 and 50 minutes for focus; 5 and 10 minutes for short break; 15 minutes for long break), default labels, default and beta app icons, and Today Insights.

Tempo Pro includes all free features plus custom durations for focus and break sessions, the ability to add custom labels, premium app icons, all insights (beyond Today), Tempo Cards in the main content view, App Blocker scenarios per label, and upcoming features such as Live Activity, Widgets, and Standby Design. Features marked "Soon" may become available in future updates.

We reserve the right to add, modify, or remove features from either tier with reasonable notice where practicable.

4. Subscriptions and Purchases

Tempo Pro is available through monthly, annual, or lifetime purchase options. Subscriptions (monthly and annual) automatically renew unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription in your device Settings under Apple ID, Subscriptions.

Refunds are handled by Apple according to Apple's standard refund policy. We do not process refunds directly. If you believe you are entitled to a refund, please contact Apple Support or submit a request through reportaproblem.apple.com.

We may change subscription prices from time to time. If we increase the price of a subscription you already have, we will notify you in advance (for example, via email or in-app notice), and the new price will apply at the start of your next billing period. You may cancel before the new price takes effect if you do not agree.

5. Acceptable Use

You agree to use Tempo only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the App. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the App. You may not use the App to distribute malware, spam, or harmful content. You may not resell, redistribute, or sublicense access to the App or its features.

We reserve the right to take action, including suspending or terminating access, if we reasonably believe you have violated these Terms or abused the App. We do not actively monitor usage but may investigate reported abuse.

6. Intellectual Property

The App, its design, code, and content (except where otherwise noted) are owned by Stoleru Martin PFA or our licensors. Some icons used in the App are from Lucide (lucide.dev) and are used under their license. All other materials are our property.

You retain ownership of any data you create within the App, such as your focus sessions, labels, and statistics. By using the App, you grant us only the limited rights necessary to provide the service (for example, to store and sync your data when you use iCloud sync).

7. Discontinuation of the App

We may discontinue the App or certain features at any time. If we do so, we will endeavor to give you reasonable advance notice where possible. If you have an active subscription at the time of discontinuation, you may be entitled to a refund or partial refund under applicable law; please contact us for assistance.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Stoleru Martin PFA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the App, even if we have been advised of the possibility of such damages. Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim, or, if you have not paid, fifty euros (EUR 50).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above may not apply to you.

10. Consumer Rights (EEA and UK)

If you are a consumer in the European Economic Area or the United Kingdom, you have statutory rights that cannot be waived by these Terms. Nothing in these Terms affects those rights. For example, you may have the right to withdraw from a distance contract within 14 days under certain conditions, and you may have rights regarding defective digital content. 11. Governing Law and Disputes

These Terms are governed by the laws of Romania. Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Romania, except where mandatory consumer protection laws in your country require otherwise.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top and notify you in the App. Continued use of the App after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the App.
